These terms apply to this website and to the Free to Build program. Please read them before joining the waitlist or purchasing a place in a cohort. Free to Build is operated by Subunit Ecom Ltd in Nova Scotia, Canada.
What the program is
Free to Build is a twelve-week facilitated program in which we work with you to install an operating system into your business — direction, people, rhythm, process and data. It is delivered through recorded teaching, templates, written materials, group discussion, and live sessions.
It is education and facilitation. We work alongside you; we do not run your business, and we do not do the work for you. What you get out of the program depends substantially on what you put into it.
No guarantee of results
We make no promise, representation or warranty that participating in this program will increase your revenue, your profit, the value of your business, or the amount of time you have available. We do not promise any particular business outcome.
Business results depend on countless factors outside our control or knowledge — your market, your team, your capital, your decisions, the economy, and how consistently you apply what is taught. Any example, case study, testimonial or figure shown on this site describes a specific situation and is not a prediction of what will happen in yours.
The implementation guarantee — what it does and does not cover
We offer one specific, limited guarantee, and it is about the installation, not about outcomes.
If, by the end of week twelve, the core operating rhythm is not running in your business — quarterly priorities set, your weekly leadership meeting happening, and your scorecard live — we will continue working with you at no additional cost until it is, up to a maximum of four additional two-hour sessions.
This guarantee applies only where you have attended the sessions, completed the assigned work, and given us the access and information needed to do the work. It does not apply where the required work has not been done, or where circumstances in your business have made installation impossible.
This guarantee is the entire remedy we offer in relation to program delivery. It is not a money-back guarantee, and it does not entitle you to a refund. We chose it deliberately: we can honestly guarantee the install, because we facilitate it. We cannot honestly guarantee what your business does afterwards.
Payment, cancellation and refunds
Fees are stated at the point of purchase and are payable in full before the cohort begins. Payment is processed by Stripe and is subject to Stripe’s own terms.
Because places in a cohort are strictly limited and holding a place means turning others away, fees are non-refundable once a cohort has begun, except where the implementation guarantee above applies or where we cancel.
If you need to withdraw before a cohort starts, contact us and we will deal with it reasonably, including where possible transferring your place to a later cohort.
If we cancel a cohort before it begins, you will receive a full refund.
Not professional advice
Nothing in this program or on this website is legal, accounting, tax, financial, investment, employment or medical advice, and none of it should be relied on as a substitute for advice from a qualified professional who knows your circumstances.
Decisions about your business — including decisions about people, contracts, structure, compliance and money — remain entirely yours, and you should take proper professional advice before making them.
Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, opportunity, goodwill or data, however it arises.
- Our total liability arising out of or in connection with the program or this website — whether in contract, tort (including negligence), or otherwise — is limited to the amount you actually paid us.
- We are not liable for any decision you make, or do not make, as a result of the program.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not permit certain exclusions, in which case those exclusions apply only to the extent permitted.
Confidentiality
Cohorts involve business owners discussing real and often sensitive details of their companies. What is shared in the cohort stays in the cohort. By taking part you agree not to disclose another participant’s confidential business information outside the program.
We treat your business information the same way, and will not disclose it without your permission — except where we are legally required to.
Recording
Live sessions may be recorded so that participants can revisit them and so that material can be developed for future teaching. If you take part in a recorded session, you agree to that recording. If you would prefer not to appear, tell us and we will accommodate it.
Intellectual property
All materials provided in the program — templates, written material, recordings, frameworks and documentation — remain our property. You may use them freely inside your own business, for as long as you like.
You may not resell them, publish them, distribute them outside your business, or use them to deliver a competing paid program or consulting service.
Your responsibilities
To get value from the program, and for the guarantee above to apply, you need to attend the sessions, do the work between them, and involve the people in your business whose participation the work requires. We will tell you clearly what is needed and when.
Website content
We try to keep this website accurate and current, but we do not warrant that it is free of errors, and content may change without notice. Links to other websites are provided for convenience; we are not responsible for their content.
Governing law
These terms are governed by the laws of Nova Scotia, Canada, and the courts of Nova Scotia, Canada have exclusive jurisdiction over any dispute — except where the law of your own country gives you rights that cannot be overridden by agreement.
Changes
We may update these terms. The version that applies to your purchase is the one published when you bought your place.
